This type of leave expressly applies to pregnant employees,
and is relevant whether the employee is full time, part time or
It occurs when a pregnant employee is fit to work, but it is in-
advisable for them to continue in their present position during
a period because of risks associated with the pregnancy or
hazards connected with that position.
An employer would usually become aware of the need for the
employee to be given alternative duties because the em-
ployee presents the employer with a medical certificate. The
certificate might, for example, require that the employee be
given duties that do not require her to lift items, or stand for
long periods of time.
It is then the responsibility of the employer to provide the
employee with alternative duties that comply with the medical
restrictions. If there are no suitable alternative duties, then
the employee will be entitled to “No Safe Job” leave for the
risk period. This will be paid, if the employee is going to be
entitled to unpaid Parental Leave under the National Em-
ployment Standards, ie she will have more than 12 months’
service at the time the leave will commence. If the employee
is not entitled to unpaid Parental Leave, this will be unpaid

payment is for the employee’s ordinary hours of work at her
base rate of pay.
The risk period will be indicated by the employee’s doctor on
the medical certificate, and there is no limit on the amount of
leave that can be taken in this way. However, the risk period
will finish when unpaid parental leave commences. In the
last six weeks of pregnancy, an employer may require the
employee to provide further medical evidence that she would
otherwise be fit for work. If she cannot do that, then she may
be required to commence her unpaid Parental Leave early.
