IN MODERN AWARDS
The General Retail Industry Award 2010 allows an employer to
make an agreement with an employee about the payment of penalty
rates and overtime rates (such as a flat rate agreement) provided
the steps set out in the clause 7 are followed. This includes carefully
documenting what is included in the flat rate, and setting out how
the employee is better off when compared to the award provisions.
For most employers, this would entail putting together a comparison
of how much an employee would be entitled to get for a typical period,
including penalty rates and overtime rates. The employer would then
compare that to the proposed flat rate for working the same number of
hours. This, of course, only works when an employee's hours and days
of work do not vary too much, because the employee must always be
better off overall compared to the award.
An employee must be able to freely choose to decline to sign
a flexibility arrangement and stay on award provisions, and an
employee must not be offered a position conditional on them
signing a flexibility arrangement. Either party to the agreement can
terminate the agreement with 28 days written notice -- at which point
the employee would revert to award provisions for all time worked.
